In 2019, Choi Jong Bum was indicted by prosecutors for violating the Special Case Act Regarding Sexual Crimes (recording body parts without consent), assaults that caused bodily damage, intimidation, coercion, and property damage and damage. In his first trial last August, he received a sentence of one year and six months in prison, suspended for three years on probation. He and the prosecutor appealed.
The Choi Jong Bum appeal court was held on May 21 in which he pleaded guilty to all charges except those involving non-consensual filmmaking. The court sentenced him on July 2. The suspension of Choi Jong Bum's first trial was canceled and he was sentenced to one year in prison. He was placed under court arrest to prevent him from going abroad.
In its ruling, the judge stated, "Sexual intercourse is one of the most intimate aspects of a person's privacy, and threatens to expose videos, this can not only cause irreparable psychological damage to victims, but can also greatly damage the honor of their relationship." They added, "Not only this, but the defendant made threats to expose videos openly misusing the fact that such videos will produce more serious damage because the victim is a celebrity."
But the court also upheld the previous verdict that Choi Jong Bum was innocent of filming the victim's body without consent. It was explained, "Based on the evidence presented by the prosecutor, it is still difficult to say without doubt that filmmaking took place without approval."
After the trial, Choi Jong Bum was asked by the court whether he had anything to say about the verdict, and he replied, "Not at this time." While Goo Ho In, Goo Hara's brother, expressed his regret over the court's decision.
"I see the fact that he was given a prison sentence without delay as a small source of comfort for our family which will help reduce our pain. But we regret that he was not proven to record video without consent and that he was only sentenced to one year," he said.
He added, "When my brother was still alive, he saw him being sentenced to prison by suspension, but I think he was satisfied to know that the suspension was lifted today." He concluded by stating that he would ask the prosecutor to file a final appeal to increase the prison sentence given by Choi Jong Bum.
