VIVIZ wins interim lawsuit over exclusive contract and can resume activities independently
Girl group VIVIZ, consisting of Eunha, SinB, and Umji, has won a temporary lawsuit regarding their exclusive contract dispute against their agency, One Hundred.
The court's decision allows the three VIVIZ members to continue pursuing their entertainment activities independently while the main lawsuit proceeds.
On June 5, the Civil Division of the Seoul Central District Court granted VIVIZ's entire request for a temporary suspension of the exclusive contract.
In its ruling, the court stated that the effectiveness of the exclusive contract between the two parties is suspended until a final ruling is rendered.
The court also prohibited the agency from negotiating or signing contracts with third parties on behalf of the VIVIZ members without their consent.
Furthermore, the company is not allowed to force the members to engage in entertainment activities or require others to restrict their activities.
Last March, VIVIZ announced the termination of the contract, citing breach of income payment obligations and lack of management support.
During the trial, the judge ruled that the company had failed to fulfill its obligation to pay the income that each member was due.
The court estimated that the unpaid income to each member exceeded 100 million won (approximately 1.16 billion Rupiah), thus deeming the violation proven.
The agency argued that the payment difficulties were triggered by issues of a struggle for control of the company and false reports against its leadership.
However, the judge emphasized, "The attempted control struggle by external parties and false media reports are merely circumstances unrelated to the petitioners."
This case adds to the growing list of artists under the One Hundred label network embroiled in contract disputes over alleged late payment of income.
